Terms and Conditions

These Terms and Conditions govern the sale of products by Sodaflo Limited (“Sodaflo” or “we”) to you. Sodaflo Limited is a Company registered in England and Wales with the registration number 11661374 and registered address Cromwell House, The Lane, West Deeping, Peterborough PE6 9HS.

Please read these Terms and Conditions carefully before placing an order with Sodaflo. By placing an order with Sodaflo, you signify your agreement to be bound by these Terms and Conditions and the Privacy Policy.

1. OUR CONTRACT

Orders can be placed online at the Sodaflo shop website. The representation of the products does not constitute a legally binding offer but a request to place an order.  All orders are subject to availability and to acceptance by us, and we may correct any product representation at any time. The contract can only be concluded in English.

Prior to the order despatch, you can view and modify the data at any time and remove products from the shopping cart. By confirming your order online, this constitutes a binding offer to us for conclusion of contract. Once you place an order, we will send an order confirmation email confirming receipt of the order that lists the order details. This order confirmation does not constitute acceptance of the offer. We will send you a shipping confirmation email to confirm that your order has been despatched for delivery. This is confirmation and acceptance of your order and the contract is concluded. Sodaflo is the contractual partner, and does not offer products for purchase by individuals under 18 years.

2. PRODUCTS AND WARRANTY

2.1 Products described on our website, including photographs, are for illustrative purposes only and while the appearance of the products may vary, the products shall materially conform to their description on the website.

2.2 Sodaflo drinksmakers carry a two year limited warranty. Sodaflo warrants to replace any equipment found to be malfunctioning due to faulty materials or workmanship, without cost to you, within the two-year period starting from the date of your purchase. Faults arising from misuse of Sodaflo products, being use which does not comply with the user instructions, are excluded from this warranty.

3. RETURNS

3.1 You have the right to return your order to us within 30 days of the date of delivery, provided that the products have not been used or damaged and they are returned in the original packaging. 3.2 To be eligible for a full refund, all products must be returned to us in good condition within 30 days of the date of delivery.

3.3 Nothing in this clause affects your statutory rights of return if the products are faulty or your product warranty.

4. PRICING AND AVAILABILITY

4.1 All prices stated on our website are inclusive of VAT and shipping costs are also clearly stated.

4.2 Prices may be changed at any time, however this will not affect your order once it has been placed and accepted.

4.3 We will endeavour to fulfil all orders received however if we are out of stock or otherwise unable to deliver your order, we will inform you and offer a full refund for any unavailable items.

4.4  Payment for products must be made before delivery.

5. DELIVERY

5.1 Shipping costs may be changed at any time, however this will not affect your order once it has been placed and accepted.

5.2  We only deliver to residential addresses within the United Kingdom.

5.3  Delivery time for orders will be determined by our chosen carrier’s service applicable at the time of the order.

5.4 We will endeavour to provide you with an estimated delivery time once your products have been shipped.

6. DATA AND PRIVACY

7. LIABILITY

7.1 Nothing in these Terms and Conditions affects Sodaflo’s liability for death or injury arising from our negligence, or for fraud or misrepresentation, or any other liability that cannot be excluded or limited by English law.

7.2 To the fullest extent permitted by law, Sodaflo expressly excludes all conditions, warranties and other terms that might be otherwise included by law.

7.3 You are responsible for using Sodaflo products in strict conformity with the provided user instructions. Sodaflo excludes all liability that arises as a result of your use of the product where this does not conform with the user instructions provided.

7.4 Subject to condition 7.1 above, our maximum liability to you, whether in contract, tort (including negligence) or otherwise in relation to the products purchased by you shall be limited to the price you paid for those products.

8. APPLICABLE LAW

These conditions are governed by the laws of England.  We both agree to submit to the non-exclusive jurisdiction of the courts of England, which means that you may bring a claim to enforce your consumer protection rights in connection with these Terms and Conditions in England.

9. AMENDMENTS TO THE CONDITIONS OF SALE

We reserve the right to make changes to our website, policies, and terms and conditions, including these Terms and Conditions at any time. 

10. STATUTORY RIGHTS

These Conditions are without prejudice to your statutory rights.
